The present application has been filed for modification of the order dated 23.08.2016 passed in Cr. Misc. No. 26379 of 2016 by which the petitioners were granted bail in connection with Sursand P.S. Case No. 50 of 2016, pending in the court of learned Chief Judicial Magistrate, Sitamarhi. It has been submitted on behalf of the petitioner no.5

Patna High Court Cr.Misc. No.2028 of 2017 (2) dt.25-01-2017 2/2 that since the name of the father of the petitioner no.5 has been described as 'Biltu Sada' in column no. 7 of the F.I.R, but inadvertently the name of his father has wrongly been mentioned as 'Nitu Sada' in the cause title of bail petition. Therefore, prayer has been made to rectify the name of the father of petitioner no.5 as Biltu Sada @ Nitu Sada, in place of Nitu Sada. Considering the aforesaid facts and circumstances, let the name of the father of the petitioner no.5 be read as Biltu Sada @ Nitu Sada.

Accordingly, the order dated 23.08.2016 passed in Cr. Misc. No. 26379 of 2016, is modified to the extent as indicated above.

The modification application is, accordingly, disposed of.
