The petitioner seeks bail in a case registered under Section 379 of the Indian Penal Code.

Prosecution case, in short, is that on 7.4.2019 the motorcycle of the informant has lost from Ashok Kumar, Road No.11 in front of house of C.M. Sharma.

It has been submitted on behalf of the petitioner that the petitioner is in custody 23.04.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. He has not been put on T.I.P. One key is alleged to have been recovered. The said key belongs to the petitioner. Except for this, there is no other substantive evidence

Patna High Court CR. MISC. No.51011 of 2019(2) dt.17-08-2019 2/2 to suggest his implication in the present case. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Smt. Madhavi Singh, J.M. 1st class, Patna in connection with Kankarbag P.S. case No.375 of 2019.
