The petitioner apprehends his arrest in Buxar Town P.S. Case No. 235/2015, registered for the offences punishable under Section 401, 414 and 34 of the Indian Penal Code. The A.S.I. along with two police officers alleged that on information, the house of the petitioner was raided and two motorcycles was recovered, one bearing registration no. BR 44B9493 and second without number, from the house of the petitioner, but the petitioner did not produce any paper relating to those motorcycles.

It is submitted that the owner of the vehicles filed petition before the Court for releasing of the vehicles. The

Patna High Court Cr.Misc. No.40809 of 2015 (2) dt.06-10-2015 2/2 motorcycles were not stolen, but it appears from the petition that petitioner has got criminal antecedent and many cases are pending against him. In most of the cases, he has been acquitted, but still one case is going on.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
