JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 08-08-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.
It is a case of commission of murder by the husband and in-laws of the deceased.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner is the Nanad of the deceased and the main allegation is against the husband of the deceased who is in judicial custody. There is no specific allegation against her and no active role play for commission of murder to the deceased. Petitioner has clean antecedent.
Patna High Court CR. MISC. No.64109 of 2021(4) dt.08-08-2022 2/2 Learned APP appearing for the State opposed the anticipatory bail.
Considering the aforesaid submissions as well as the fact that petitioner being lady, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Angira Kumari, Judicial Magistrate Ist Class, Purnea/concerned Court in connection with Dagarua P.S. Case No. 125 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
