2. The petitioner is named in the F.I.R. and is in custody since 05.05.2022.
3. It is third successive bail prayer of petitioner on the ground of parity that similarly situated co-accused, namely, Dharmendra Kumar Singh @ Dharmendra Singh, considering period of custody alone was granted bail by learned co-ordinate Bench of this Court without touching the merit. It appears that the petitioner remains in custody since 05.05.2022 where similarly situated coaccused, namely, Dharmendra Kumar Singh @ Dharmendra Singh was granted regular bail by one of the
Patna High Court CR. MISC. No.60006 of 2024(3) dt.13-12-2024 2/3 learned co-ordinate Bench through Cr. Misc. No. 49349 of 2024 dated 12.07.2024.
4. A report was also called for from the learned trial court regarding stage of trial which was made available to this Court through letter no 404 dated 02.12.2024. It transpired from the aforesaid letter that now this case record is fixed for evidence on behalf of the defence and till date two defense witnesses has been examined.
5. Considering the aforesaid report it appears that now delay is on the part of accused petitioner. Now due to changed circumstances petitioner can't claim parity on the ground of the fact that co-accused Dharmendra Kumar Singh @ Dharmendra Singh was granted regular bail by this Court.
6. Considering the aforesaid, the prayer of bail of this petitioner is hereby rejected.
7. Learned trial court is directed to conclude the trial preferably within two months from the date of
Patna High Court CR. MISC. No.60006 of 2024(3) dt.13-12-2024 3/3 receiving of this order subject to co-operation of the accused petitioner.
