The petitioner apprehends his arrest in Matihani P.S. case No. 65 of 2014 under Section 452, 376, 511 and other Sections of the Indian Penal Code.

The informant alleged that while she was all alone in her house, the petitioner entered and made abortive attempt to commit rape with her and fled away after snatching ornaments from her neck.

The learned counsel for the petitioner submits that petitioner has falsely been implicated in the case. It is a case of love affairs. The occurrence took place on 01.06.2014 but the FIR was lodged after one day of the occurrence.

Patna High Court Cr.Misc. No.45781 of 2016 (3) dt.16-12-2016 2/2 It appears that there is specific allegation against the petitioner that he made abortive attempt to commit rape with the victim.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
