JUSTICE SANJAY PRIYA ORAL ORDER 2/ 13-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Rohtas P.S. Case No.114 of 2016 instituted for the offence under Section(s) 147, 148, 149, 341, 323, 325, 307, 302 Indian Penal Code and Section 3⁄4 of Witch Craft Act.

It is alleged that on the date of occurrence thirteen accused persons named in the written report, which included the name of this petitioner also, assaulted the informant and his mother with iron rod, Gandasa and lathi etc. The mother of the informant subsequently died in course of treatment. It has been submitted that it is not clear from the written report as to who gave the fatal blow on the mother of the informant causing her death. It has further been submitted that

Patna High Court Cr.Misc. No.1197 of 2017 (2) dt.13-01-2017 2/2 similarly situated co-accused Lalan Kumar has been granted bail by a co-ordinate Bench of this Court vide order dated 13.12.2016 passed in Cr. Misc. No.40874 of 2016.

In the circumstances, let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st class, Dehri-On-Sone, Rohtas, in connection with Rohtas P.S. Case No.114 of 2016, subject to the conditions that both the bailors shall be close relative of the petitioner.
