====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-04-2018 Heard the learned counsels for the petitioners and the State.

The petitioners seek bail in anticipation of their arrest in connection with Forbisganj P.S. Case No. 466 of 2017 dated 26.06.2017 instituted for the offence under Section 379 of the Indian Penal Code.

A bolero vehicle was stolen. Later, one Vinod Rai was arrested along with the stolen vehicle. The aforesaid Vinod Rai is said to have confessed before the police in which he has taken the name of the petitioners. The petitioners thereafter were made accused in Maharajganj P.S. Case No. 121 of 2017 also.

Learned counsel for the petitioner has submitted that in the aforesaid case viz. Maharajganj P.S. Case No. 121 of 2017, the petitioners have been

Patna High Court Cr.Misc. No.15865 of 2018(2) dt.06-04-2018 2/2 granted anticipatory bail by a Bench of this Court vide order dated 19.01.2018 passed in Cr. Misc. No. 2586 of 2018.

Regard being had to the fact that the name of the petitioners has transpired in the confession a of coaccused and that they have been granted bail in the case which was lodged on the recovery of the vehicle along with one Vinod Rai, this Court is inclined to grant anticipatory bail to the petitioners in the present case also.

The petitioners above named are directed to be released in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Forbisganj P.S. Case No. 466 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
