JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-04-2018 The petitioners seek bail in anticipation of thier arrest in connection with Khaira P.S. Case No. 228 of 2017, dated 03.08.2017, instituted for the offences punishable under Sections 341, 323, 448, 307, 337 and 504/34 of the Indian Penal Code.

The petitioners are the wives of the agnates of the informant. So far as the allegation against them is concerned, they are alleged to have indulged in throwing brick-bats when the other members of the family of the petitioners assaulted the son of the informant. The specific

Patna High Court Cr.Misc. No.15879 of 2018 (2) dt.09-04-2018 2/2 act of assault has been attributed to one Prem Yadav, whose assault led to the injuries on the brother-in-law of the informant. The others also are alleged to have specifically assaulted the members of the prosecution side. There is a counter version of the occurrence also vide Khaira P.S. Case No. 227 of 2017, which also has been instituted under almost the same sections in which the petitioners have been made accused.

Regard being had to the fact that the petitioners are not specifically alleged to have assaulted anybody and that the dispute is between the two families of the agnates, this Court is inclined to enlarge the petitioners on anticipatory bail.

Let the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Khaira P.S.
