The petitioner apprehends his arrest in Raniganj P.S. Case No.54 of 2018 registered under Sections 307, 379 and other minor Sections of the Indian Penal Code. The informant named altogether nine persons and alleged that they all having armed with different weapons came and abused the informant and his family members and disclosed that they would not accept the measurement of the land. All the accused persons caught the informant and assaulted him. Razabul(the petitioner) is alleged to have assaulted the mother of the informant with fist and slab after putting her down on the ground.

The learned counsel for the petitioner submits that there is a case and counter case. Raniganj P.S. Case No.55 of

Patna High Court CR. MISC. No.52733 of 2019(2) dt.23-08-2019 2/2 2018 is registered on behalf of the petitioner. The occurrence took place due to land dispute. On account of assault made by the petitioner, mother of the informant got simple injury. Other accused person, namely, Md. Soyeb has already been granted anticipatory bail.

Taking into consideration the facts aforesaid and the fact that there is a case and counter case and the petitioner is alleged to have assaulted mother of the informant with fist and slab but mother of the informant got simple injury, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Raniganj P.S. Case No.54 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Saurabh/- U T
