JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 144,341,448,380 and 504 of the Indian Penal Code.

Though the petitioner was not sent up for trial but differing with the final form, cognizance has been taken against the petitioner under section 461 IPC.

The prosecution case is that in absence of the informant on 20.7.2007 the petitioner along with others variously armed, entered into the house of the uncle of the informant, broke the lock and took away the boxes containing ornaments, cash and other articles.

It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.39906 of 2015 (2) dt.06-10-2015 2/2 that the accusation is omnibus and general. On conclusion of investigation, the accusation was not found true against the petitioner.

Since the case is of 2007, this court is not inclined to grant anticipatory bail to the petitioner but considering the fact that on conclusion of investigation, the accusation was not found true against the petitioner, it is a case for consideration of regular bail by the learned court below in case the petitioner surrenders within six weeks from today in connection with Kamtaul P.S. Case No. 48 of 2007 pending in the court of learned C.J.M. Darbhanga. This application is disposed of with the aforesaid observation/direction.
