The petitioner, apprehending his arrest in connection with Dehri Nagar P.S. Case No. 344 of 2015 registered for the offence punishable under Section 147, 148, 379, 411, 120B, 353, 332, 504, 506, 307 of the Indian Penal Code, 4(1-A) 21(1) D.E. Act, 40 (1) of the Bihar Mines Act and 33/41/42 of the Indian Forest Act, has prayed for grant of anticipatory bail. Learned counsel for the petitioner by way of referring to statement made in paragraph no. 6 of the petition submits that petitioner is the owner of the vehicle bearing registration no. CG04JD/0418 which was given on hire. However, the petitioner only being owner of the vehicle, who hails from the state of
Patna High Court Cr.Misc. No.47688 of 2015 (2) dt.16-10-2015 2/2 Chhatisgarh has been made accused. He further submits that even though there is no cogent material to show that any offence with the vehicle was committed with the active connivance of the petitioner, the petitioner has been made accused. He further submits that in this case all the witnesses who have been examined till date are police officials.
In view of the facts and circumstances, in the event of arrest or surrender within a period of eight weeks from today, let the petitioner Ramakant Singh be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dehri in connection with Dehri Nagar P.S. Case No. 344 of 2015.
