The petitioner seeks bail in connection with Baruraj P.S. Case No. 295 of 2018 dated 02.12.2018 instituted for the offence under Section 395 of the Indian Penal Code.

The petitioner is not named in the FIR and his implication in this case is on the basis of confession of a co-accused person. There is no recovery of any looted article from his possession. In the earlier case which was lodged against him, he is on bail. In that case also, his implication was on the basis of a confession made by one of the arrested accused person.

Learned counsel for the petitioner submits that because of the implication of the petitioner once in a

Patna High Court CR. MISC. No.50698 of 2019(36) dt.20-11-2019 2/2 case of this kind, every time, whenever there is no clue with respect to accusation in any other case of similar nature, the petitioner is remanded to custody. The petitioner is said to be in custody since 28.03.2019.

For the aforestated facts, the petitioner above named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Muzaffarpur in connection with Baruraj P.S. Case No. 295 of 2018.
