This is a petition for grant of anticipatory bail for offence under Sections 420 and 409 of the Indian Penal Code and 7 of the Essential Commodities Act.
The petitioner is the owner of the referred truck owner having national permit. Wheat was seized from the said truck on allegation that the same was meant for the supply in the Government schemes. The owner of the wheat has also lodged the case against the informant alleging therein that when he failed to fulfill the demand of the informant as wheat was wrongly seized, which he had purchased from the farmers.
Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Thawe P.S. Case No. 116 of 2016 to the satisfaction of the Chief Judicial Magistrate, Gopalganj, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
