ANJANA MISHRA ORAL ORDER 06-10-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Riga P.S. Case No.70 of 2015 for allegedly having committed the offence under Sections 302,120B/34 of the Indian Penal Code and Section 3(2)(V) of the S.C./ST Act. Learned counsel for the petitioner submits that the present case has been lodged against the petitioner only on the basis of suspicion that on the day of Holi, the deceased had put colour on the daughter of the petitioner.
Learned counsel appearing on behalf of the State after perusing the case diary submits that there is no further material in the case diary so as to implicate the petitioner save
Patna High Court Cr.Misc. No.29404 of 2015 (3) dt.06-10-2015 2/2 and except the speculation formed by the informant. Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, in connection with Riga P.S. Case No.70 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
