KUMAR ORAL ORDER 17-02-2018 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in Belsand P.S. Case No.100 of 2017 for the offences registered under Sections 420, 467, 468, 471, 472, 409, 473, 474, 475 and 477 (A) of the Indian Penal Code r/w Section 17 of Banking Act. Informant, who is account holder of Customer Service Centre of State Bank of India, has filed complaint before the CJM, Sitamarhi, stating that he and other witnesses of the complaint petition had deposited money in their accounts but same was not entered in the ledger book and on query it was disclosed that money was not deposited. The case was referred to police for institution of FIR under Section 156(3) of the Code of Criminal Procedure. Allegation is made against Accused No. 1 and 3 only and no allegation is made against
Patna High Court Cr.Misc. No.2037 of 2018(3) dt.17-02-2018 2/2 petitioner in entire complaint who is accused no. 2 in complaint case.
Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/ (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Sitamarhi, in Belsand P. S. Case No. 100 of 2017 ,subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
