JUSTICE SANJAY PRIYA ORAL ORDER 23-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Mahnar P.S. Case No. 126 of 2016, G.R. No. 3692 of 2016 instituted for the offence under Sections 414/34 of the Indian Penal Code.
It is alleged in the written report of the informant that on confidential information that Jitender Kumar and Bittu Kumar are keeping stolen motorcycle in their house, they rushed there and recovered motorcycle. The police also learnt that one member of that group namely, Md. Aslam (petitioner) is also keeping the stolen motorcycle and on such information, the police party reached Lawapur chowk and apprehended the petitioner with C.D. Deluxe Motorcycle.
Learned A.P.P. has submitted that the petitioner has
Patna High Court Cr.Misc. No.4546 of 2017 (3) dt.23-02-2017 2/2 confessed before the police that the recovered motorcycle is stolen one.
It has been submitted that the petitioner is in custody since 17.9.2016. The investigation has been completed and charge sheet has been submitted.
In such circumstances, keeping in view the period spent by petitioner in custody and the investigation has been completed, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IV, Vaishali at Hajipur, in connection with Mahnar P.S. Case No. 126 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner. The petitioner in any manner will not try to hamper the trial by intimidating or influencing the witnesses and will remain present on each and every date of trial. Any two subsequent defaults will result in cancellation of bail bonds in the court below.
