The petitioner apprehends his arrest in Aurangabad Town P.S. case No. 85 of 2011 under Section 420, 467, 468, 120B of the Indian Penal Code.

The informant alleged that he deposited Rs. 20,000/- in the name of his wife and Rs. 20,000/- in the name of Sanjay Kumar with OCPL Insurance Company and receipts were given by the accused persons.

It is submitted that petitioner is only named in the complaint petition at serial No.1 but no specific allegation is made against him. Similarly situated accused Surendra Mishra and Haribansh Singh have already been granted anticipatory bail vide

Patna High Court Cr.Misc. No.39770 of 2016 (5) dt.10-11-2016 2/2 order passed in Cr. Misc. Nos. 8194 of 2015 and 17319 of 2015. It appears that case of petitioner stands on same footing. Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Aurangabad Town P.S. Case No. 85 of 2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
