JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Again, I am not inclined to release the petitioner on bail on the grounds mentioned by me in my previous order dated 22.06.2016 passed in Cr. Misc. No. 25740 of 2016 and accordingly, his prayer for bail in connection with Sessions Trial No. 734 of 2016 arising out of Belchi P.S. Case No. 06 of 2016 pending in the court of 2nd Additional Sessions Judge, Barh stands rejected.
However, learned trial court should expedite the trial of
Patna High Court Cr.Misc. No.6448 of 2017 (3) dt.12-04-2017 2/2 the petitioner and try to conclude the same as early as possible, preferably within six months from the date of receipt/production of copy of this order, failing which petitioner may renew his prayer for bail before the learned trial court itself.
