1. Heard learned counsel for the petitioner and Mr. Chandra Bhushan Prasad, learned A.P.P. for the State.

2. Learned A.P.P. for the State submits that in compliance of the order dated 19.08.2025, a counter affidavit duly sworn by the Senior Superintendent of Police, Patna has been filed. It is further submitted that the police after investigation came to a considered conclusion that petitioner is innocent thus submitted final form exonerating the petitioner of the allegation as alleged in the FIR.

3. Learned counsel for the petitioner does not dispute the said submission and as such seeks permission to withdraw the anticipatory bail application with liberty to file afresh, if need arises.

4. Permission is accorded.

5. Accordingly, the instant anticipatory bail

Patna High Court CR. MISC. No.53592 of 2025(3) dt.07-10-2025 2/2 application is dismissed as withdrawn in connection with Naubatpur P.S. Case No. 112 of 2025 pending in the Court of learned Additional Chief Judicial Magistrate-VI, Danapur/Successor Court.
