The petitioner seeks anticipatory bail in connection with Agamkuan PS case no. 96 of 2017 registered for the offences punishable under Sections 302/201/34 of the Indian Penal Code. The allegation is regarding the accused persons killing the deceased lady.

The learned counsel for the petitioner submits that the deceased lady was staying with her husband separately and whatever had transpired in between the wife and the husband is not in the knowledge of the petitioner herein who happens to be the elder brother of the husband of the deceased lady. It is further submitted that other similarly situated co-accused

Patna High Court Cr.Misc. No.6674 of 2018 (3) dt.23-02-2018 2/2 persons have been granted anticipatory bail by this Court in Cr. Misc. No. 55590 of 2017 by order dated 23.11.2017 and Cr. Misc. No.41302 of 2017 by order dated7.12.2017.

Having regard to the facts and circumstances of the case, in the event of arrest or surrender before the concerned court within a period of six weeks from the date of receipt/production of a copy of the present order, the petitioner above named is directed to be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Patna City in connection with Agamkuan PS case no. 96 of 2017, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
