Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Section 414 of the Indian Penal Code, registered in connection with Supplementary K.Hat (Madhubani) P.S.Case No. 439 of 2019.

The learned counsel for the petitioner has submitted that except the confessional statement of co-accused, there is nothing against the petitioner. The arrested co-accused has stated that Sumo vehicle was handed over to the arrested accused by the present petitioner. He has submitted further that the seized vehicle does not belong to the petitioner. Considering the above facts and circumstances and

No.64105 of 2021(3) dt.20-09-2022 2/2 also considering the clean antecedent of the petitioner, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with K.Hat (Madhubani) P.S.Case No. 439 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P.C.

The learned court below shall verify the criminal antecedent of the petitioner and if it comes to the notice of the court below that there is any other case against the petitioner, except the present one, the court below shall be at liberty to cancel the bail bond of the petitioner. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
