The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420,467,468 and 471 of the Indian Penal Code. It is alleged that Rs.6,50,000/- was transferred from the Madhya Bihar Gramin Bank, Nawada branch to the account of Manoj Mandal and subsequently Rs.3,00000/- was withdrawn from the said account. During investigation, it was found that by using the password of cashier Ashwini Kumar Lal, the transfer was made. The name of the petitioner sprang up during investigation when the witnesses suggested that the petitioner being computer

Patna High Court Cr.Misc. No.32028 of 2013 (5) dt.07-04-2015 2/3 maintenance staff operated the computer on the alleged date of occurrence. Subsequently, it was found that said Manoj Mandal in whose account the amount of rupees three lacs was transferred, is a fake person. It is submitted by the learned counsel for the petitioner that only on suspicion the petitioner has been roped in the present case. Admittedly, by use of the password of the cashier the amount was transferred but the cashier has not been made accused.

It is submitted by learned counsel for the state that the sweeper of the bank in his statement suggests that the petitioner operated the computer.

Considering the fact that this fact has not been verified that actually the transfer was made by the petitioner and Statement made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Patna in connection with Kankarbagh P.S.
