The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 272/290 of the Indian Penal Code and Section 47(A) of the Excise Act. Learned counsel for the petitioner submits that the alleged recoveries were not made from his conscious possession rather from a motorcycle and that the seizure-list does not bear his signature.
Having considered the facts and circumstances, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/-
Patna High Court Cr.Misc. No.27514 of 2016 (2) dt.20-08-2016 P2/2 (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Nawanagar (Sonbarsa) P.S. Case No. 21/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
