ANJANA MISHRA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 147/341 /323/324/307/379 of the Indian Penal Code.

Learned counsel for the petitioners submits that admittedly, the occurrence took place on account of demolition of boundarywall. It is submitted that there is land dispute between the parties. Further, learned counsel for the petitioner submits that the injury purported to have been inflicted on the vital part, is against Ranjay Kumar (petitioner No. 1) which is said to be simple in nature. So far as Mukesh Yadav (petitioner No. 4) is concerned, it is submitted that he had assaulted on the head, but it has hit his finger and the injury is found to be simple in nature. So far as

Patna High Court Cr.Misc. No.27515 of 2016 (2) dt.20-08-2016 P2/2 other petitioners are concerned, there is no specific allegation of having given injury to them.

Considering the facts and circumstances of the case and that the petitioners have no criminal antecedent, let the petitioners above named, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj, in connection with Barauli P.S. Case No. 96 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
