The petitioner apprehends his arrest in Bajpatti P.S. Case No.124 of 2019 registered under Sections 363, 366A and 34 of the Indian Penal Code.
The informant alleged that her daughter became traceless and when the informant went inside the room of the victim, the informant found a mobile lying on the bed having calls with four mobile numbers. One of the mobile numbers was of the petitioner.
Learned counsel for the petitioner submits that the victim made her statement under section 164 of the Cr.P.C. and she disclosed that she went with Chandan on his motorcycle. When Chandan stopped his motorcycle in front of his house, the petitioner also came there and immediately thereafter she
Patna High Court CR. MISC. No.49926 of 2019(2) dt.13-08-2019 2/2 became unconscious and she got her consciousness in hospital. The victim did not disclose that the petitioner kidnapped her. The victim accompanied with Chandan on his motorcycle. Having considered the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Pupari, Sitamarhi in connection with Bajpatti P.S. Case No.124 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
