JUSTICE SHAILENDRA SINGH ORAL ORDER 17-12-2025 Heard Mr. Mritunjay Kumar, learned counsel for the petitioners, Mr. Anil Prasad Singh and Mr. Umeshanand Pandit, learned APPs appearing for the State.
2. Petitioners seek regular bail in connection with Mahua P.S. Case No. 676/ 2020 dated 27.11.2020 registered for the offence(s) punishable under Sections 341, 323, 324, 504, 506 read with section 34 of the IPC.

The main submissions advanced by the petitioners' counsel are that two FIRs were lodged in connection with the alleged occurrence, in the first FIR, six persons were named whereas in the subsequent FIR, 11 persons were named and the subsequent FIR was merged with the first FIR, the name of the petitioner Md. Elias did not find place in the first FIR though he was named in the subsequent FIR and no specific allegation has been levelled against him and he has been languishing in jail since 18.09.2023. Learned counsel further submits that petitioner, Md. Anjar has been languishing in jail since 04.10.2021 and there is no criminal antecedent against him after merging of the Mahua P.S. Case No. 698 of 2020 with the FIR of the present case and so far as the nature of the allegation against him is concerned, he is alleged to have assaulted one injured, namely, Bhuvaneshwar Kumar but he is not alleged to have assaulted the deceased and further, the alleged incident was not pre-planned and the same took place in the spur of the moment on account of tying of cattle and flow of water.
4. On the other hand, learned APPs appearing for the State have vehemently opposed the bail prayer of the petitioners and have submitted that serious allegations have been levelled against the petitioners and in the alleged occurrence, several
Patna High Court CR. MISC. No.51490 of 2025(5) dt.17-12-2025 3/3 persons sustained grievous sharp-cut injuries and both the petitioners are named in the FIR.
5. Heard both the sides and perused the FIR and the case diary of this case. Though, the instant matter relates to the serious occurrence of murder and attempt to murder but considering the nature of the allegations appearing against the petitioners and mainly taking into account their custody period, this court is inclined to release the petitioners on bail. Accordingly, let the petitioners named-above be released on bail in connection with Mahua P.S. Case No. 676/ 2020 on furnishing bail bond of Rs. 20,000/-( Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned.
