JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 08-12-2025 Learned counsel for the petitioner has outset prayed that due to mistake he could not implead the Bank as party. He may be permitted to implead the Bank as party. The learned counsel for the Bank is present.

3. Heard learned counsel for the petitioner, learned counsel for the Bank and learned APP for the State.
4. The petitioner has prayed for bail in connection with Chhatauni P.S. Case No. 34 of 2023 registered for the offence punishable under Sections 403, 406, 417, 420, 468, 465, 471, 120(B)/34 of the Indian Penal Code.

5. The case of the prosecution, in short, is that the petitioner along with other 318 accused persons have committed fraud and cheated with the Bank as they have submitted forged and fabricated documents as a proof of ownership of lands to the Bank and took the heavy loans.
6. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is ready to settle the dispute with the Bank and he is ready to pay the loan amount i.e. Rs. 5 lakhs. He is languishing in judicial custody since 26.04.2024.
7. Learned counsel appearing on behalf of the Bank and learned APP appearing for the State have no objection if the petitioner is ready to pay all the dues.
8. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Chhatauni P.S. Case No. 34 of 2023.
9. Petitioner is directed to pay Rs. 5 Lakhs to the
Patna High Court CR. MISC. No.56359 of 2025(5) dt.08-12-2025 3/3 Bank within a period of six months in six equal installments and if he fails to pay the said amount within the stipulated period, his bail bonds will be cancelled.
