The petitioner apprehends his arrest in connection with Sitamarhi Police Station Case No.982 of 2018 registered under Sections 147, 148, 149, 336, 337, 338, 353, 296, 295A, 153A, 505, 324, 326, 302 and 201 of the Indian Penal Code. Learned counsel for the petitioner submits that it would appear from the F.I.R. that Amit Kumar alias Raja, Raushan Kumar, Sri Vishwajit Rai, Sunny Kumar and Vikky Kumar were apprehended on the spot, who disclosed the name of 69 persons, whose descriptions are detailed in the F.I.R., but the petitioner is not named in the F.I.R. Regarding the same occurrence, Sitamarhi P.S. Case No.984 of 2018 was also

Patna High Court CR. MISC. No.52797 of 2019(2) dt.23-08-2019 2/2 instituted on the basis of the self statement of the Officer Incharge of Sitamarhi Police Station but the name of the petitioner has not been disclosed in the aforesaid case. In course of investigation, it has only come that the petitioner was seen in the procession of 1500 people. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi Police Station Case No.982 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
