====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 31-01-2024 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 406, 420, 120(B), 506/34 of the Indian Penal Code.
3. Allegation against the petitioners is that they have taken money from informant as dowry for marriage of informant's daughter with one Mukesh Kumar Prasad but due to some reason marriage has not solemnized.

4. It is submitted by learned counsel for the petitioners that petitioners are innocent and have committed no offence. No such occurrence as alleged ever took place. Petitioners have been falsely implicated in this case. The allegation levelled against the petitioners is not specific rather general and omnibus in nature. On bare perusal of F.I.R., it appears that petitioner no.1 is the brother-in-law (Bahnoi) and petitioner no.2 is the mother, petitioner no.3 is the maternal uncle and petitioner no.4 is the brother-in-law (Bahnoi) of co-accused, Mukesh Kumar Prasad who allegedly have to marry with the daughter of the informant. Petitioners have no role in this matter. It is further submitted that said amount i.e. Rs. 6,00,000/- six lakh has been returned to the informant annexed as annexure-2 with this petition. Petitioners have no criminal antecedents as mentioned in para-3 of this application.
5. Learned APP for the State opposed the prayer for bail.
6. Having regard to the facts and circumstances of the case, the petitioners are from distant relatives of co-accused, Mukesh Kumar Prasad, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty
