The present petition has been filed for grant of regular bail on behalf of the petitioner in connection with Bela P.S. Case No. 143 of 2018 registered for the offence punishable under Sections Sections 341, 323 and 307/34 of the Indian Penal Code. Later on, Section 302 I.P.C. has been added to the set of allegations.

The allegation is regarding the accused persons having assaulted the husband of the informant, who is said to have died on account of the injuries sustained by him. The learned counsel for the petitioner has referred to the postmortem report, annexed to the case diary, wherein no internal or external injury has been found and it has been stated

Patna High Court CR. MISC. No.49706 of 2019(3) dt.27-09-2019 2/2 that the deceased died on account of cardiac arrest, he was suffering from liver disease and his age has been stated to be about 75 years. It has been further submitted that the petitioner has been falsely implicated in the present case, he is languishing in custody since 13.06.2019 and is having a clean antecedent. Having regard to the facts and circumstances of the present case, this Court deems it fit and proper to grant regular bail to the petitioner, above named, on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand), with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sadar, Sitamarhi in connection with Bela P.S. Case No. 143 of 2018.
