Petitioner's claim for appointment as Dafadar has been admitted by the respondents in the counter affidavit. Specific averment in paragraph 10 of the counter affidavit reads as follows:

"10. That in light of the order dated 15.12.2021 (Annexure 3 of the writ petition) passed in CWJC No 139 of 2021, the State of Bihar had earlier filed LPA No 148 of 2022 against the aforesaid order but the District Compassionate Committee in its meeting held on 10.11.2022 has unanimously decided to withdraw the said LPA as the case of the petitioners has been found to be covered as per

Patna High Court CWJC No.14222 of 2022(3) dt.24-11-2022 2/2 the aforesaid judgments passed by the Hon'ble Court and also in view of the provisions contained in Rule 4.C (1) of the Bihar State Litigation Policy, 2011. Thus, the District Appointment Committee has unanimously given approval vide Memo No 3611, dated 11.11.2022 (Annexure A) for appointments of the candidates as mentioned at Serial No 1 to 13 of the aforesaid letter issued in this regard."

In view of the aforesaid decision, nothing survives in the writ petition. It is now for the authorities to carry forward the said decision in favour of the petitioner, which they should do expeditiously and preferably within eight weeks from the date of receipt/production of a copy of this order. Writ petition stands disposed of.
