The petitioner apprehends his arrest in connection with Pipra P.S. Case No. 125 of 2014 registered under Sections 147, 323, 324, 307, 379, 354, 504 and 506 of the Indian Penal Code.
The accusation is that in course of cutting tree by the informant and his family members for cremation of his deceased brother, petitioner & 7 others named in the F.I.R. assaulted the informant and his family members and snatched bicycle and cash Rs. 2500/- Learned counsel appearing on behalf of the petitioner submits that while the petitioner is named in the F.I.R. along with
Patna High Court Cr.Misc. No.47308 of 2015 (2) dt.27-01-2016 2/2 7 others, but the specific allegation is only against co-accused Dev Ram Sharma to cause injury at the head of the informant and also snatch cash Rs. 2500/- from the pocket of the brother of the informant. It is also submitted on behalf of the petitioner that petitioner is only a member of the mob.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Supaul in connection with Pipra P.S. Case No. 125 of 2014, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
