JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-03-2017 The petitioner is apprehending his arrest in connection with Complaint Case No. 1375C of 2015, registered for offences punishable under Sections 498A of Indian Penal Code and Section 4 of Dowry Prohibition Act.
It has been submitted on behalf of the petitioner that in this case there is delay of seven days in lodging the present complaint case. Further the petitioner is ready to settle the dispute but it is the complainant-opposite party no. 2, who in spite of notice by this Court did not appear and she also did not appear before the court below, which itself shows the intention of complainant-opposite party no. 2 that the present case has been filed only to harass the petitioner. So far allegation is concerned only general and omnibus allegation has been made against the petitioner and other accused persons.
Patna High Court Cr.Misc. No.927 of 2017 (3) dt.18-03-2017 2/2 Heard learned A.P.P. also.
Having heard both sides, in view of the fact that petitioner is ready to settle the dispute with complainant-opposite party no. 2, but in spite of notice by this Court, the complainantopposite party no. 2, is not turning up in this case, which shows her intention that she is not interested in keeping matrimonial relationship, as such, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Bettiah, West Champaran in connection with Complaint Case No. 1375C/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
