The petitioner apprehends her arrest in Rajgir P.S. Case No.156 of 2017 registered under Sections 302, 201 and 34 of the Indian Penal Code.
The father of the deceased alleged that his daughter, Lalita Devi was married with Gorelal Yadav 17 years ago. His daughter got two sons but her father-in-law, brother-in-law, sisterin-law killed her. The husband of his daughter living in Ludhiana. The learned counsel for the petitioner submits that petitioner is sister-in-law(gotni) of the deceased. The petitioner has no manner of concern with the family affairs of the deceased and her husband, Gorelal Yadav. Similarly situated co-accused,
Patna High Court Cr.Misc. No.11462 of 2018 (3) dt.08-03-2018 Kuleshwari Devi, another sister-in-law of the deceased has already been granted anticipatory bail vide order passed in Cr. Misc. No.52845 of 2017. Other accused persons have been granted regular bail.
Considering the facts aforesaid and the fact that the petitioner is sister-in-law of the deceased and there is no specific allegation made against the petitioner, the petitioner, above named, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IV, Nalanda at Biharsharif in connection with Rajgir P.S. Case No.156 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
