Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in connection with Chandramandi P.S. Case No. 21 of 2022, registered for the offences punishable under Sections 341, 323, 307, 379, 324, 120(B) and 34 of the Indian Penal Code.
The learned counsel for the petitioner has submitted that there is no allegation on the petitioner that he inflicted assault on the person of the informant or his son. The FIR shows itself that other unknown persons had assaulted them and the
Patna High Court CR. MISC. No.53647 of 2022(2) dt.30-01-2023 2/2 petitioner and one co-accused Suresh Das were in that conspiracy. The petitioner is a person of clean antecedent. Considering the above-mentioned facts and circumstances as well as the clean antecedent of the petitioner, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 4th Jamui in connection with Chandramandi P.S. Case No. 21 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided hereinabove, failing which the matter shall be brought to the notice of this Court.
