JUSTICE BIRENDRA KUMAR ORAL ORDER 15-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 302/34 of the Indian Penal Code.

For land dispute between the parties two named accused, namely, Manoj Singh and Vikash Singh took Ankit Kumar, the grand son of the informant on the pretext to play. Thereafter, the informant heard cry of Ankit Kumar and when reached near Ankit, he found the named accused persons including the petitioner fleeing from there.

Patna High Court Cr.Misc. No.1348 of 2017 (3) dt.15-03-2017 2/2 Learned counsel for the petitioner submits that there is no eyewitness of the occurrence and after notice of the dead-body in the field side, on suspicion due to land dispute the present false case has been lodged.

Considering the fact that for the purpose of bail there is no substantial material against the petitioner, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur/Successor Court, in connection with Hajipur Sadar P.S. Case No.304 of 2016.
