The petitioner apprehends his arrest in Bhagwanpur P.S. Case No. 12 of 2016 registered for the offences punishable under Sections 420, 414 and 120B of the Indian Penal Code. The police got secret information that in the godown of Dinesh Chaudhary stolen biscuits were kept. On such the police raided the place and apprehended Dinesh Chaudhary and Munni Lal Sahni. Dinesh Chaudhary, the owner of the godown disclosed that the cartons of biscuits were brought by Munni Lal Sahni who had taken the godown on rent. Munni Lal Sahni disclosed that the biscuits belong to the petitioner Bidhan Singh @ Vidhan Kumar. Learned counsel for the petitioner submits that save and except the statement of Munni Lal Sahni there is no material

Patna High Court Cr.Misc. No.49526 of 2016 (4) dt.15-03-2017 2/2 against the petitioner, but it appears that Munni Lal Sahni disclosed that the petitioner was also present at the place of occurrence near the godown but after seeing the police he fled away and the truck seized from the vicinity of the godown belongs to the petitioner.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.

The petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail, his prayer shall be considered on its own merit without being prejudiced from the order of this Court and taking into consideration that Dinesh Chaudhary and Munni Lal Sahni have already been enlarged on regular bail.
