JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 24.11.2016 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with a case registered under sections 467, 468, 471 and 420/34 of the Indian Penal Code.
Petitioner appears to have played a role of broker and the petitioner and one co- accused introduced the informant with Asgari Khatoon who happens to be executor of the sale deed in question.
Moreover, co- accused Md. Sharjeel Ahmad @ Sharjeel Ahmad @ Chand has already been granted privilege of anticipatory bail and similarly, husband of Asgari Khatoon has also been released on regular bail.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of the
Patna High Court Cr.Misc. No.42748 of 2016 (2) dt.24-11-2016 fact that the petitioner does not have any criminal antecedent, in the event of arrest/ surrender within six weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif in Bihar P.S. Case no. 148/2016 subject to condition as laid down under section 438(2) of the Cr.P.C.
