====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 05-08-2025 Heard Mr. Ganesh Prasad Singh, learned counsel appearing on behalf of the petitioner and Mr. Yatindra Narayan, learned AC to GP-16 for the State.

2. The petitioner in paragraph no. 1 of the present writ petition has sought, inter alia, following relief(s), which is reproduced hereinafter:- "A. To issue direction, order or writ in the nature of Mandamus, or any other appropriate writ/writs, order/orders, direction/directions, commanding the respondents for fixation of salary of the petitioner from initial date of selection/posting i.e. from 11.02.2012 and pay arrear of salary for the periods the petitioner had worked and also the period the respondent authority has restrained to the petitioner to perform his duty on the post of Assistant Teacher as the petitioner was selected vide order dated 11.02.2012 on the post of Regular Assistant Teacher (Trained) 34540 in Pay band P2-(9300-34800) Grade-Pay Rs. 4200/- and latter on wrongly terminated to the petitioner vide letter dated 03.05.2013 and after long litigation the respondent has reinstated to the petitioner vide letter dated 11.03.2024 from the date of his initial posting. B. To issue a direction, order, or writ upon the

Patna High Court CWJC No.12506 of 2025(2) dt.05-08-2025 2/2 respondents to grant all subsequent benefit to the petitioner who has been reinstated in the from the date of his termination on the post of Assistant Teacher (Trained)34540 grade, as similarly situated persons have already been granted the same benefit in light of judgment rendered in L.P.A. No. 1254 of 2016, and analogous matter, L.P.A. No. 1309 of 2017 and L.P.A No. 1310 of 2017.

C. To issue any other relief/reliefs that the petitioner may be found to be entitled in the fact and circumstances of the present case."

Learned counsel appearing on behalf of the petitioner informs that he has received instruction that the petitioner seeks to avail remedy before the Director, Primary Education, Bihar and he has already filed a representation on 24.06.2025 (Annexure-4) before the Director, Primary Education, Bihar which is pending for its adjudication and disposal.

4. Considering the aforesaid information, the petitioner, if so desires, may pursue remedy before the Director, Primary Education, Bihar, who in turn must not delay to dispose of the representation of the petitioner dated 24.06.2025 which has been filed for the relief as prayed for in the present writ petition in accordance with law, well within a period of six weeks expeditiously.

5. The writ petition stands disposed of.
