The petitioner apprehends his arrest in Jagdishpur P.S. Case No. 167/2012, registered for the offences punishable under Section 25(1-b)A, 26 and 35 of the Arms Act.
The petitioner being the informant alleged that Md. Chhotan @ Naushad and his son Md. Gulab armed with country made pistol assaulted the informant. The villagers came and tied them in the electric pole. The villagers recovered one country made rifle and produced the same before the police but the police during course of investigation after three years of the occurrence filed requisition stating the facts that it was the petitioner who transplanted the arms showing the recovery from Md. Chhotan @ Naushad and his son Md. Gulab.

Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Jagdishpur P.S. Case No. 167/2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi/- U T
