JUSTICE RAKESH KUMAR ORAL ORDER 14-09-2016 Heard Sri Aaruni Singh, learned counsel for the petitioner and Sri Pawan Kumar Chaurasiya, learned Additional Public Prosecutor.

The sole petitioner, who is named as accused with specific accusation of opening firing and order giver on whose order one another person opened firing which hit the brother of the informant from back side has approached this court with a plea for grant of anticipatory bail in Sasaram (M) P.S. Case No. 1075 of 2015 registered for the offence under section 302/ 34 of the Indian Penal Code and Section 27 of the Arms Act . It was submitted by Sri Aaruni Singh, learned counsel for the petitioner that F.I.R. is concocted. As per the F.I.R. occurrence had taken place in the night in between 17. 9.2015 -

Patna High Court Cr.Misc. No.38119 of 2016 (3) dt.14-09-2016 2/2 18.9.2015 and F.I.R. was lodged belatedly at least after 14 hours of the alleged occurrence. He also tried to persuade the court that in newspaper certain facts were disclosed, which indicates false implication.

After going through the F.I.R. the Court is of the opinion that it is not a case for grant of privilege of anticipatory bail.

The petition stands dismissed.
