JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-04-2018 The petitioner seeks bail in anticipation of her arrest in connection with Chakia P.S. Case No. 01 of 2017, dated 03.01.2017, instituted for the offences punishable under Sections 147, 447, 342, 427, 323, 420, 467, 468, 471, 502 and 34 of the Indian Penal Code.

The petitioner is alleged to have purchased a land from one Lal Babu Pathak, which land is claimed to have been gifted to the informant by her grandmother. Learned counsel for the petitioner has drawn the

No.15989 of 2018 (2) dt.09-04-2018 2/2 attention of this Court to the fact that the vendor of the petitioner and the father of the informant come from the same stock of the family and in the Partition suit, bearing No. 3237 of 1986, the land in question was allotted in favour of the aforesaid Lal Babu Pathak.

It has been submitted on behalf of the petitioner that in any view of the matter, the dispute appears to be of a civil nature inasmuch as there are rival claims over the said plot of the land which has been purchased by the petitioner. Considering the aforesaid facts and the nature of accusation levelled in the First Information Report, let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-13th, Motihari, East Champaran in connection with Chakia P.S. Case No. 01 of 2017.
