2. In this case, the petitioner is seeking regular bail in connection with Madanpur P.S. Case No. 148 of 2024, registered for the offences punishable under Section 30(a)(c) of Bihar Prohibition and Excise (Amendment) Act, 2022.
3. The prosecution case in brief is that a raid was conducted based on a confidential information. The informant along with the police team reached near Keshhar River where they observed smoke rising from multiple locations. Upon seeing the police, four persons began to flee and managed to escape. During the search, 6000 litres of Java Mahua, 250 litres of liquor and equipment used for liquor production were found
Patna High Court CR. MISC. No.58707 of 2024(2) dt.22-08-2024 2/2 and seized on the spot. The local chowkidar identified two fled persons as Anuj Yadav (petitioner) and Virendra Yadav.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. Nothing has been recovered from the conscious possession of the petitioner and the petitioner was not arrested from the place of occurrence. The petitioner is under custody since 10.07.2024.
5. On the other hand, learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, the petitioner, above-named, is directed to furnish bail bond after six months from today and on doing so, the court below shall release the petitioner on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, First, Aurangabad in connection with Madanpur P.S. Case No. 148 of 2024, subject to the following condition:- The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
