Petitioner is accused in connection with Chandradeep P.S. Case No. 109 of 2016 registered under Sections 376 of the I.P.C.

The accusation is of making sexual relation with the informant on the assurance of marriage.

Learned counsel appearing on behalf of the petitioner submits that the age of the informant has been mentioned in the F.I.R. as 22 years. In fact, the parents of the victim girl wanted to marry her with the petitioner, which was refused. From the F.I.R., it appears that nowhere assurance of marriage has been mentioned. It is also submitted that petitioner has no criminal antecedent and is in custody since 26.11.2016.

Patna High Court Cr.Misc. No.2014 of 2017 (2) dt.30-01-2017 2/2 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of J.M., 1st Class, Jamui in connection with Chandradeep P.S. Case No. 109 of 2016.
