2. The petitioner apprehends arrest in a case registered under Sections 30(a) of Bihar Prohibition and Excise Act.
3. As per the prosecution case, there is recovery of 10 litres of country made liquor from the house of the petitioner and it is alleged that he fled away from the place of occurrence.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Petitioner has no concern with the seized illicit liquor. Two brothers are also residing in the same house and it is not clear from where the recovery was made. There is no independent seizure list witness. Further submission is that the petitioner was not present at the spot and there is no recovery from his
Patna High Court CR. MISC. No.54799 of 2025(2) dt.27-08-2025 2/2 conscious possession. Petitioner has one criminal antecedent, which is other than the Excise Act in which he is on bail. Petitioner undertakes to cooperate in the investigation and trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. 5, Gaya in connection with Gurua P.S.
