These appeals are under Section 14(A)(2) of the Schedule Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989 against the refusal of prayer for anticipatory bail by the
Patna High Court CR. APP (SJ) No.15 of 2018 (4) dt.08-02-2018 2/2 learned 1st Additional Sessions Judge, Nawada, in connection with Nawada S.C.S.T. P.S. Case No.20 of 2016 registered under Sections 147, 149, 341, 323, 504, 379, 383 of the Indian Penal Code and Sections 3(i)(r)(s) 2(i) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. The F.I.R. apparently discloses the commission of offence under the provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act against the appellants for the purpose of prayer for anticipatory bail. Hence, the prayer is bared under Section 18 of the SC/ST Act. The background of allegation and motive of false implication can not be a ground to create jurisdiction to entertain prayer for anticipatory bail in spite of statutory Bar. Therefore, these appeals have got no merit and accordingly, these appeals stand dismissed.
