2. The petitioner apprehends his arrest in a case registered for offence under Sections 363, 366A of the Indian Penal Code.
3. As per prosecution case, this petitioner, with the help of other F.I.R. named accused persons, kidnapped niece of the informant for the purpose of marriage.
4. Learned counsel for the petitioner submits that entire prosecution case, as set out in the F.I.R., is false and fabricated. In fact, there was love-affairs between petitioner and niece of informant. During investigation, the victim was recovered and her statement under Section 164 Cr.P.C. was recorded wherein she stated that she has performed marraige out of her sweet will and has stated her age, as 18 years & 11 months. Petitioner has got clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the statement of the victim recorded under Section 164 Cr.P.C. and clean antecedent of petitioner, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, (East) Muzaffarpur in connection with Hathauri P.S. Case No. 259 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
