The petitioner seeks bail in connection with Kishanganj P.S. Case No.471 of 2016 registered under Sections 30 and 36 of the Bihar Prohibition and Excise Act, 2016. The accusation is of recovery of 113 bottles, each containing 375 ml. Indian Made Foreign Liquor, from a Maruti Omini Van. The petitioner and one Manoj Sonar were apprehended by the police from the Maruti Omini Van. Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner was Khalasi of the Maruti Omini Van, which was being driven by the co-accused Manoj

The petitioner having no criminal antecedent is in custody since 08.10.2016 Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj, in connection with Kishanganj P.S. Case No.471 of 2016.
