This application for anticipatory bail arises out of Baikunthpur P.S. Case No. 97 of 2019 for the offence punishable under Sections 304B, 201, 120B and 365/34 of the Indian Penal Code and Section 3/4 of D.P.Act. The petitioner No.1 is father-in-law and the petitioner No. 2 is mother-in-law of the deceased. Referring to the First Information Report itself, learned counsel appearing on behalf of the petitioners has submitted that apparently deceased was living with her husband at different place at Hazaribagh and not with these petitioners. He has also submitted that there is no specific allegation against these petitioners and demand of dowry soon before the death of

Patna High Court CR. MISC. No.50007 of 2019(2) dt.09-08-2019 2/2 the deceased. It has further been argued that as per the First Information Report itself, the marriage was solemnized in 2012, according to the informant.

Considering the facts and circumstances, this application is allowed.

Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gopalganj, in Baikunthpur P.S. Case No. 97 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
